Sheffield City Council v Hazel St. Claire Oliver [2017] EWCA Civ. 225: LA Appeal Decision re Funding of Major Works

The local authority appealed a decision of the Upper Tribunal concerning the funding of major works. The local authority had received a degree of Government Funding. The Government funding only covered part of the estate in total including the block in which the respondent lived. The local authority sought to recover the costs from the respondent without deducting the funding received. The local authority treated the funding as a contribution to the project as a whole and not just those leaseholders strictly eligible.
The Court of Appeal dismissed the appeal and said that the local authority must give credit for the third party funding to prevent a “double recovery”.
