Corvan (Properties) Limited v. Maha Ahmed Abdel-Mahmoud [2017] UKUT 228 (LC): Consultation Relating to a QLTA

A relatively rare case in which the Upper Tribunal considered consultation relating to a qualifying long terms agreement.
In this case an agreement with managing agents provided that it was to be for one year which “will continue thereafter until terminated by notice…”. The FTT found that as a result of the additional words this agreement was for more than 12 months and consultation under Section 20 of the Landlord and Tenant Act 1985 applied.
The Upper Tribunal agreed with the FTT’s interpretation. On the construction of the terms of the agreement this ran for more than 12 months and was only determinable upon notice.
